Labor Certification

A foreign national and his or her immediate family may become Legal Permanent Residents of the United States if a U.S. Company petitions for a Labor Certification for the individual. This pathway to permanent residency is one of the most common for employer-sponsored immigrants.

H-1B Visa

U.S. Based Companies who wish to hire Foreign National Individuals for specialty occupations — positions that require a minimum of a Bachelor's Degree — may petition for an H-1B visa. This is the most widely used work visa category for professionals in fields such as technology, engineering, finance, and medicine.

TN Visa

Created under NAFTA, the TN visa permits qualified Canadian and Mexican citizens to seek temporary entry to engage in business at a professional level. Eligible professions include accountants, engineers, lawyers, pharmacists, scientists, and teachers.

E-1 Treaty Traders / E-2 Treaty Investors

The E-1 classification allows nationals of a treaty country to engage in international trade on their own behalf. The E-2 classification allows nationals of a treaty country to invest a substantial amount of capital in a U.S. business. Both categories require that the applicant's home country has a qualifying treaty of commerce and navigation with the United States.

H-2B Visa

The H-2B non-agricultural temporary worker program allows U.S. employers to bring foreign nationals to the United States to fill temporary nonagricultural jobs. Employers must demonstrate that there are not enough U.S. workers who are able, willing, qualified, and available to do the temporary work.

L-1A — Intercompany Transferee Executive or Manager

The L-1A visa enables a U.S. employer to transfer an executive or manager from an affiliated foreign office to one of its U.S. offices. It also enables a foreign company that does not yet have an affiliated U.S. office to send an executive or manager to the U.S. to establish a new office.

L-1B — Intercompany Transferee with Specialized Knowledge

The L-1B visa enables a U.S. employer to transfer a professional employee with specialized knowledge relating to the organization's interests from an affiliated foreign office to a U.S. office. It also enables a foreign company to send a specialized knowledge employee to the U.S. to help establish a new U.S. office.
